I have been reading - MassHealth Transmittal Letter AFC-11, January 2007,
To: Adult Foster Care Providers Participating in MassHealth.
1. I was unable to find any reference as to when the regulations will go
into effect for Adult Foster Care Caregivers. Will it be soon?
2. Although I do see that 408.404 (A)(6) states: “agree to pay AFC
caregivers on a timely basis for services provided at applicable
compensation levels.”, I was unable to find any reference to a “Rates of
Payment” section regarding what these levels will be. What will the new
rates be?
3. As 408.434 (A)(4) states: “employ or independently contract with an AFC
caregiver;”, does this mean that I will no longer be a volunteer? (Please
contact ******** of the Boston Office for context).

As outlined in the MassHealth Transmittal Letter AFC-11, dated January 2007, providers should discard their AFC guidelines, and begin referring to the AFC regulations transmitted in this letter effective 2/1/2007.
Please refer to Transmittal Letter AFC-10, dated November 2006, which describes the Level II payment rate, conditions of payment, AFC responsibilities and care requirements, and billing requirements of the new rate.

Thank you for your response. I did read in Transmittal Letter AFC-11 that the effective date for AFC * providers * was February 1, 2007. My question is, when will the new regulations be effective for AFC * caregivers * ?
Transmittal Letter AFC-10 does describe the new (effective December 1, 2006) Level-II payment rate. But I am more concerned about the Level-I payment rate. What will it be and when will it start?
Regarding 408.434 (A)(4), were you able to contact ******** of the Boston Office? I believe that he can most clearly provide details pertaining to my concerns. Essentially I would like to know what my legal status as AFC caregiver will be when the regulations go into effect for caregivers. That is, Volunteer, or Employee?

The AFC regulations at 130 CMR 408.000 went into effect on 2/1/2007. There is no ’separate AFC caregiver regulation’. The AFC Caregiver Qualifications and Responsibilities can be found in section: 408.433 of the regulation.
Please note there was no change to the Level I payment rate to AFC providers.
Regarding ‘legal status as an AFC caregiver’, it is recommended to speak to the AFC facility you are affiliated with for this information.
