The Grateful Dead and our managing organizations have long encouraged the purely noncommercial exchange of music taped at our concerts and those of our individual members. That a new medium of distribution has arisen - digital audio files being traded over the Internet - does not change our policy in this regard. Our stipulations regarding digital distribution are merely extensions of those long-standing principles and they are as follow:

No commercial gain may be sought by websites offering digital files of our music, whether through advertising, exploiting databases compiled from their traffic, or any other means.

All participants in such digital exchange acknowledge and respect the copyrights of the performers, writers and publishers of the music.

This notice should be clearly posted on all sites engaged in this activity.

We reserve the ability to withdraw our sanction of noncommercial digital music should circumstances arise that compromise our ability to protect and steward the integrity of our work.

This site acknowledges and respects Phish's trademarks, copyrights and other proprietary rights, including but not limited to the band's and related enterprises' exclusive ownership of company and band names, Phish music, performances, likenesses, lyrics, copyrighted images and other content. It does not use material derived in whole or in part from official material generated by Phish (from www.phish.com or elsewhere), their writers, publishers, management and/or other sources, which is protected by U.S. and international copyright and trademark laws. No material from www.phish.com (including but not limited to text, images, performances, audio and/or video) and no software (including but not limited to any images or files incorporated in or generated by the software or data accompanying such software) has been or will be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, modified or used for any other purpose without Phish's express written permission.
